Please read these terms carefully before using the PrimePlaces website or making a booking.
Introduction
Welcome to PrimePlaces. These Terms of Service ("Terms") govern your use of the primeplaces.co.za website and all related services provided by PrimePlaces ("we", "us", or "our"). By accessing or using our website, creating an account, or making a booking, you agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use our website or services.
Definitions
For the purposes of these Terms:
• "Guest" refers to any person who creates an account, makes a booking, or uses our services.
• "Property" refers to any short-term rental accommodation listed on our platform.
• "Booking" refers to a confirmed reservation for a Property made through our website.
• "Platform" refers to the PrimePlaces website at primeplaces.co.za and all associated services.
Eligibility
You must be at least 18 years of age to use our services or make a booking. By using our Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
Account Registration
To make a booking, you may be required to create an account. You may register using social login providers (Google, Apple, GitHub, or X) or via email and password.
You are responsible for:
• Providing accurate and complete information during registration.
• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
You must notify us immediately if you suspect any unauthorised use of your account.
Bookings and Reservations
All bookings made through PrimePlaces are subject to availability and confirmation. By making a booking, you agree to:
• Pay the total amount due, including nightly rates, cleaning fees, and any applicable charges.
• Abide by the check-in and check-out times specified for the Property.
• Comply with the Property rules and any instructions provided by PrimePlaces or the property owner.
• Use the Property solely for lawful purposes and in accordance with its intended use as short-term accommodation.
PrimePlaces reserves the right to refuse or cancel any booking at our discretion, including in cases of suspected fraud, violation of these Terms, or unavailability of the Property.
Pricing and Payment
All prices displayed on our website are in South African Rand (ZAR) unless otherwise stated. Prices are subject to change without prior notice, but confirmed bookings will be honoured at the price quoted at the time of booking.
Payments are processed securely through PayFast, a licensed South African payment gateway. We do not store your credit or debit card details.
Full payment is required at the time of booking to confirm your reservation. A booking is only confirmed once payment has been successfully processed and you receive a booking confirmation.
Cancellation and Refund Policy
Cancellations are subject to the following policy:
• More than 30 days before check-in: Full refund of the total booking amount.
• 15–30 days before check-in: 50% refund of the total booking amount.
• Less than 15 days before check-in: No refund.
• No-show: No refund will be issued.
All cancellation requests must be submitted in writing via email to stay@primeplaces.co.za.
PrimePlaces reserves the right to cancel a booking due to unforeseen circumstances such as property damage, maintenance issues, or force majeure events. In such cases, a full refund or alternative accommodation will be offered.
Guest Responsibilities
As a guest, you agree to:
• Treat the Property with care and respect, leaving it in a reasonable condition upon departure.
• Report any damage, maintenance issues, or safety concerns to PrimePlaces promptly.
• Not exceed the maximum number of guests specified in your booking.
• Not engage in any illegal, disruptive, or antisocial behaviour on the premises.
• Not smoke inside any Property unless explicitly permitted.
• Not bring pets unless the Property is listed as pet-friendly and prior approval has been obtained.
• Comply with building rules, body corporate regulations, and local by-laws.
You may be held liable for any damage caused to the Property or its contents during your stay, and repair or replacement costs may be charged to you.
Check-In and Check-Out
Standard check-in time is from 14:00 (2:00 PM) and check-out time is by 10:00 (10:00 AM), unless otherwise communicated for a specific Property.
Early check-in or late check-out may be available upon request but is not guaranteed and may incur additional charges. Self check-in instructions will be provided prior to your arrival.
Intellectual Property
All content on the PrimePlaces website, including but not limited to text, images, graphics, logos, icons, and software, is the property of PrimePlaces or its licensors and is protected by South African and international copyright, trademark, and intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.
AI Concierge Service
Our website features an AI-powered concierge assistant to help you find accommodation and answer questions about Cape Town. While we strive for accuracy, the AI concierge provides recommendations based on available data and may not always reflect real-time conditions.
PrimePlaces does not guarantee the accuracy, completeness, or reliability of information provided by the AI concierge. Always verify critical details such as availability and pricing before making a booking.
Limitation of Liability
To the maximum extent permitted by South African law, PrimePlaces shall not be liable for:
• Any indirect, incidental, special, consequential, or punitive damages arising from your use of our services.
• Any loss or damage resulting from circumstances beyond our reasonable control, including but not limited to natural disasters, power outages, internet disruptions, or acts of government.
• The condition, safety, or suitability of any Property listed on our platform.
• Any personal injury, property damage, or loss of belongings during your stay.
Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount paid by you for the relevant booking.
Indemnification
You agree to indemnify, defend, and hold harmless PrimePlaces, its directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from:
• Your use of our Platform or services.
• Your breach of these Terms.
• Your violation of any applicable law or regulation.
• Any damage caused to a Property during your stay.
Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.
Changes to These Terms
PrimePlaces reserves the right to modify or update these Terms at any time. Changes will be posted on this page and will take effect immediately upon publication. Your continued use of our Platform after any changes constitutes acceptance of the updated Terms.
